New "No Fault" Divorce Law

In order to obtain a divorce at present you need to show the marriage has irretrievably broken down using one of five factors. Unreasonable Behaviour, Adultery, 2 years separation with consent, 5 years separation, or desertion. Therefore unless you have been separated for more than 2 years you will need to “blame” the other spouse for their behaviour during the marriage in order to satisfy the grounds for a divorce.

Resolution have been campaigning for over 30 years to have the law changed and would allow couples to divorce without the need to apportion blame. The Government have today announced a new law to remove the need to assign blame.
